
Joan D.
Hogarth, Esq. is an attorney and experienced business professional who has
expanded her work to include arbitration and mediation. Her career began in the 80’s at AT&T's Washington,
D.C. office with her last assignment being in New York advocating AT&T’s
access policies before state regulators.
She later spent 10 years in healthcare managing various aspects of the
organization's regulatory and legal matters.
There she was partially responsible for the coordination of risk management,
credentialing and contract services. Subsequently,
as a member of the executive leadership team, her responsibilities shifted to corporate
compliance, HIPAA compliance and board governance. Today, Ms. Hogarth has launched a solo law
practice to address the regulatory and legal needs of small to medium-sized healthcare
businesses and to help individuals resolve legal issues in a non-adversarial
manner.
Ms.
Hogarth has completed intensive Alternative Dispute Resolution (ADR) training
from the AAA, New York City Bar, New York State Bar, the EEOC, FINRA, the BBB,
and the New York Courts. She is a member
of several panels to include American Health Lawyers, BBB, FINRA, the Eastern
District Courts of New York, and NYC Civil Courts. She has arbitrated over 125 cases for the BBB
and FINRA combined and has participated and co-mediated over 50 EEOC cases.
Arbitration cases included claims of employment
discrimination, labor disputes, securities disputes, Lemon Law & auto
disputes, contract disputes (interpretation, breach), breach of warranties,
delivery of damaged goods, false advertising, and other consumer
products/services concerns.
EEOC Mediation:
Claims of discrimination in the workplace, i.e. age/gender/race/sexual
harassment under Title VII, retaliation, ADA, ADEA, and wage.
Ms.
Hogarth has a JD from the George Washington University Law School; a BS degree
magna cum laude from Long Island University; and an MBA with distinction, from
the same. Her publications cover HIPAA
and compliance issues and she has delivered continuing education credits. Ms. Hogarth has served on discussion panels
at the NJ LERA. Her professional
affiliations include the NYSBA (Health Committee, Dispute Resolution Committee
as co-chair of the Website Committee, and Mediation Committee), the New York City
Bar, American Health Lawyers Association, and the NJ and NY LERA.
She is
licensed to practice law in Maryland and New York and is
excited to practice ADR throughout the United States.
