Insurance Law Committee welcomes a new Chair, Giancarlo Stanton. Mr. Stanton is
General Counsel and VP Claims with Swyfft, LLC, a data-driven insurance company.
The new Chair looks forward to the Insurance Law Committee shining a spotlight
on foundational knowledge and skills in insurance law for newly admitted attorneys,
with a special focus on the emerging trends in insurance important to both new

INSURANCE LAW COMMITTEE
The Insurance Law Committee met during the Business Law Section’s Spring Meeting on May 13th in New York City. During the well-attended session, Committee members heard a fascinating presentation from Luke Dembosky of Debevoise & Plimpton LLP entitled “Emerging Cyber Threats and Considerations When Planning for Incident Response.”
Keeping to the theme of emerging issues of interest to the insurance industry and insurance lawyers, the Insurance Law Committee will meet on January 25, 2017 during the NYSBA Annual Meeting to discuss, among other things, key trends and regulatory considerations in the insurance technology, also known as InsurTech. Members are encouraged to attend the session during the Annual Meeting, and suggested topics for future sessions are always welcome.

The
Insurance Committee met on May 15, 2015 and discussed the following topics:
investment management regulatory issues for insurance companies, trends in real
estate joint ventures, private equity investments, insurance company M&A,
catastrophe bonds, developments with life settlements, annuities, cybersecurity
and the SEC’s disclosure policies related to breaches (particularly as they relate
to material weaknesses in financial reporting), IT technology issues, IT contract
provisions and IT consulting arrangements that are problematic for insurance
and other companies, risk management, and directors and officers insurance
policy litigation issues. The Committee members particularly focused on IT
consulting-related problems around SAP implementations and big data issues, as
well as the types of IT agreement provisions that are added to allow for
providers’ workers to be replaced and other contract specific issues.

The
Insurance Law Committee met on January 29, 2014 in conjunction with the Annual
Meeting of the Business Law Section and received a presentation on current federal
and international developments in insurance regulation, including designations
of non-bank systemically important financial institutions by the federal
Financial Stability Oversight Council and recent activities of the Federal
Insurance Office and the International Association of Insurance Supervisors.

INSURANCE law COMMITTEE
The recent
months have seen a host of important regulatory developments in the insurance industry,
including: initiatives by the New York Department of Financial Services with
respect to reserving issues and the use of captive reinsurance by life insurers
and on a number of other fronts; related activity and dialogue within working groups
of the National Association of Insurance Commissioners; and, at the federal
level, the activities of the Federal Insurance Office and the Financial
Stability Oversight Council’s steps toward designating some insurance groups as
systemically significant financial institutions subject to oversight by the
Federal Reserve Board. The Committee plans to review these developments and the
Septemoutlook going forward at a meeting to be held in January 2014 in
connection with the next Annual Meeting.

Insurance law Committee
In conjunction with the Annual Meeting of the New York State Bar Association
in New York City, the Insurance Law Committee met at the New York Hilton on
January 25, 2012. The principal discussion was of the current regulatory
inquiries and enforcement proceedings regarding escheat of unclaimed life
insurance proceeds and death benefit payment practices, and included a
presentation on that topic by former New York Superintendent of Insurance Eric
Dinallo, now of Debevoise & Plimpton LLP.

Insurance law Committee
The Insurance Law Committee is composed of New York lawyers who serve clients
in the life, property and casualty, health, and the myriad other lines of
insurance-related businesses. The committee considers regulatory and
transactional issues of importance to in-house law departments and law fi rms.
The committee aims to meet at least three times a year and with outside speakers
who are expert in their respective fields. The committee follows relevant
statutory and regulatory developments such as the consolidation of the New York
State Banking and Insurance Departments into the New York State Department of
Financial Services.
